Common Questions From Our Clients

Social Media, Surveillance & Neglect are 3 things that can negatively impact your case. If you are seen physically maneuvering in ways that go against the injuries you claim to have or if your social media contradicts your claim, you’re helping to build a case against yourself. Also, if you skip your Doctor’s appointments you will appear as though your health isn’t actually the priority it should be. Be mindful of these things.

We try to resolve cases within weeks of your medical treatment ending; when you are back at your pre-accident condition or determined to be at the maximum medical improvement. This means that the length of your case is impacted by the length of treatment. At the time of treatment completion we will send demands to the insurance company for compensation.

This varies depending on the complexity of the case but in most cases it takes 4-6 weeks for us to get the outstanding balances and leans, to receive and deposit the check and for the funds to clear. Larger cases may take longer because of the number of factors involved.

If you have collision or rental coverages we can begin that process immediately. If you don’t then we’ll make a claim with the other insurance company. There can be some delays like waiting on a police report or coverage investigation. Every situation is different but we will help navigate you!

Less than 10%! If we have to file suit it’s either because we are approaching the one-year deadline or the other insurance company is being unreasonable at any time. Typically we negotiate the best compensation possible without filing suit.

You don’t pay us unless you get paid! We operate on a "contingency fee" that is collected only if we recover money for you at the end of your case. You owe the firm nothing up front, and owe us nothing while your case is ongoing. The amount of the contingency fee is different in each case because it is not a set dollar amount. Instead, the firm is paid a percentage of the total amount you recover. That percentage will be agreed to before we start work, and it will be put in writing in a signed contract. So, there is never any uncertainty about how much the fee percentage will be.

Our staff consists of two attorneys (Chaz and Bradley) and two paralegals (Sasha and Brittney) who work together on every case. This means that at any time you’ll have a fully-informed team ready to discuss any details or answer any questions you may have along the way. Communication is important to us!

In Louisiana, you may be entitled to several types of damages, including:

  • Medical Expenses: Past and future costs related to treatment, rehabilitation, and therapy.
  • Lost Wages: Compensation for income lost due to your injury.
  • Pain and Suffering: Compensation for physical pain and emotional distress.
  • Property Damage: Costs to repair or replace damaged property.
  • Punitive Damages: In cases of gross negligence or intentional harm, additional damages may be awarded to punish the wrongdoer.

Louisiana operates under a fault-based system, meaning the party responsible for the accident is liable for damages. Attorneys will investigate the incident, gather evidence, and work to establish negligence to support your claim.

It's advisable to consult with a personal injury lawyer as soon as possible after an accident. Early legal representation ensures timely evidence collection, adherence to legal deadlines, and protection of your rights.

In Louisiana, the statute of limitations for most personal injury claims is two years from the date of the accident. Failing to file within this timeframe may bar you from seeking compensation.

Louisiana follows a comparative negligence rule, meaning if you are partially at fault for the accident, your compensation may be reduced proportionally. For example, if you're 20% at fault, your compensation would be reduced by 20%.

Collecting comprehensive evidence is crucial. Consider gathering:

  • Photographs: Of the accident scene, damages, and injuries.
  • Medical Records: All documents related to your treatment.
  • Witness Information: Names and contact details of any witnesses.
  • Police Reports: Official documentation of the incident.
  • Correspondence: Any communication with insurance companies.

Hiring a lawyer can significantly impact the outcome of your case. An experienced attorney can navigate legal complexities, negotiate with insurance companies, and advocate for your best interests, often resulting in higher compensation.

  1. Seek Medical Attention: Even if injuries seem minor.
  2. Report the Incident: To the appropriate authorities.
  3. Document Everything: Gather evidence and keep records.
  4. Consult a Lawyer: To understand your legal rights and options.

Compensation for pain and suffering is subjective and varies based on factors like the severity of the injury, impact on daily life, and emotional distress. Attorneys often use a multiplier method, applying a factor to your economic damages, to estimate non-economic damages.

Yes. Insurance companies may offer quick settlements that are often lower than what you deserve. Consulting with an attorney ensures that any offer is fair and that your rights are protected.

Under Louisiana's comparative negligence law, you can still recover damages even if you're partially at fault. However, your compensation will be reduced by your percentage of fault.

Yes. Insurance companies and opposing attorneys may scrutinize your social media posts. Incriminating posts can be used to undermine your credibility or claim. It's advisable to avoid posting about your accident or injuries on social media during the legal process.
